CQC report on mental health detentions: 'Failings in the system are clear'

29 January 2026

The Care Quality Commission (CQC) has published its annual Monitoring the Mental Health Act report.

Mark Winstanley, Chief Executive of Rethink Mental Illness, said:

“People in mental health crisis should be able to expect safe care close to home, yet this year’s CQC report highlights once again a laundry list of systemic failings putting patients at risk. While we expect some improvements within the system as Mental Health Act reform is rolled out, this alone will not address a depleted workforce, continuing racial inequality, and people being sent hundreds of miles away from home for treatment. Failings in the system are clear, and we must remember that change is possible, if we learn from these lessons and prioritise action and investment.”
