What can I do if I haven’t received services under section 117 that I think I’m entitled to?

If you feel you haven’t been provided aftercare under section 117 and you should have received this, you should first bring this to the attention of your care coordinator or social worker. If your concerns are not dealt with, you could consider making a formal complaint.
You could also consider instructing a community care solicitor, who could help you to get the services you’re entitled to. You can search for a community care solicitor in your area by visiting http://legaladviserfinder.justice.gov.uk/
What can I do if I’ve been charged for services whilst on section 117?
If you’ve been charged for services that you were assessed as needing under section 117, then you may be able to claim this money back.
You should do this as soon as possible by writing to the relevant authority. If you don’t receive a full refund you should seek legal advice.
What can I do if health and social services can’t agree who is responsible for funding my care?
It is up to local PCTs and social services to decide between them where the responsibility for funding section 117 will fall. Logically it would make sense for social services to take responsibility for social care services and for PCTs to take responsibility for health care services.
